strides to improve the country&#8217;s Intellectual Property (IP) system in recent years. Some of their new initiatives, including the roll-out of the <a href=\"https:\/\/www.daniel-ip.com\/en\/blog\/unlocking-brazils-potential-advancements-in-intellectual-property-and-innovation\/\">Intellectual Property National Strategy program<\/a> in 2020, have sparked optimism, albeit cautious, amongst domestic industry practitioners and international investors. But how has this impacted the largest Brazilian patent and trademark prosecution firms?<\/p>\n<p>The present report draws upon <a href=\"https:\/\/www.ip-pilot.com\/zh-hans\/%e4%ba%a7%e5%93%81\/\">IP Pilot&#8217;s data<\/a> in patent and trademark applications first published between 2018 and 2022, to understand the developments of the largest Brazilian patent and trademark prosecution firms.<\/p>\n<\/div><div class=\"fusion-text fusion-text-6\"><h3 class=\"fusion-responsive-typography-calculated\" data-fontsize=\"32\" data-lineheight=\"37.12px\" style=\"--fontSize: 32; line-height: 1.16;\">Patent Prosecution<\/h3>\n<p><span data-fusion-font=\"true\" style=\"font-size: 18px;\">Between 2018 and 2022, 125,321 patent filings executed by 374 law firms were published. <\/span><a href=\"https:\/\/app.ip-pilot.com\/law-firms\/dannemann-siemsen-bigler-ipanema-moreira-br\/overview?date_from=2021&amp;date_to=2021&amp;date_type=M&amp;locale=en-US&amp;family_type=T,P\" data-fusion-font=\"true\" style=\"font-size: 18px;\">DANNEMANN, SIEMSEN, BIGLER &amp; IPANEMA MOREIRA<\/a><span data-fusion-font=\"true\" style=\"font-size: 18px;\">, <\/span><a href=\"https:\/\/app.ip-pilot.com\/law-firms\/kasznar-leonardos-propriedade-intelectual-br\/\" data-fusion-font=\"true\" style=\"font-size: 18px;\">KASZNAR LEONARDOS PROPRIEDADE INTELECTUAL<\/a><span data-fusion-font=\"true\" style=\"font-size: 18px;\">, <\/span><span style=\"font-size: 18px;\"><a href=\"https:\/\/app.ip-pilot.com\/law-firms\/clarkemodet-group-br\/overview?\" target=\"_blank\" rel=\"noopener noreferrer\">CLARKE MODET<\/a><\/span><span data-fusion-font=\"true\" style=\"font-size: 18px;\">, <\/span><span style=\"font-size: 18px;\"><\/span><a href=\"https:\/\/app.ip-pilot.com\/law-firms\/daniel-law-br\/overview?\"><span style=\"font-size: 18px;\">DANIEL L<\/span>AW<\/a><span data-fusion-font=\"true\" style=\"font-size: 18px;\">, and <\/span><a href=\"https:\/\/app.ip-pilot.com\/law-firms\/gusmao-labrunie-s-c-ltda-br\/?_gl=1*1uc9kfi*_ga*NzMwNDM5NDUxLjE2NzgyNTkyNzY.*_ga_GL7G9T3YS2*MTY5MDI4NzcyNC4xMTYuMS4xNjkwMjg4MjAzLjM5LjAuMA..\" data-fusion-font=\"true\" style=\"font-size: 18px;\">GUSMAO &amp; LABRUNIE S<\/a><a href=\"https:\/\/app.ip-pilot.com\/law-firms\/gusmao-labrunie-s-c-ltda-br\/\" data-fusion-font=\"true\" style=\"font-size: 18px;\">\/C LTDA<\/a><span data-fusion-font=\"true\" style=\"font-size: 18px;\"> were the 5 largest patent prosecution firms in Brazil with minimal changes in rankings or positions during this period. Granted the share and ranking for 2022 may still change because of additional publications, the current figures show they collectively represent 56% of the total volume of Brazilian patent applications.<\/span><\/p>\n<p><span data-fusion-font=\"true\" style=\"font-size: 18px;\">The 20 largest patent prosecution firms dominated over 80% of the total volume. Except <\/span><a href=\"https:\/\/app.ip-pilot.com\/law-firms\/vilage-marcas-e-patentes-ltda-br\/\" data-fusion-font=\"true\" style=\"font-size: 18px;\">VILAGE MARCAS E PATENTES LTDA.<\/a><span data-fusion-font=\"true\" style=\"font-size: 18px;\"> and <\/span><a href=\"https:\/\/app.ip-pilot.com\/law-firms\/remer-villaca-nogueira-br\/\" data-fusion-font=\"true\" style=\"font-size: 18px;\">REMER VILLA\u00c7A &amp; NOGUEIRA<\/a><span data-fusion-font=\"true\" style=\"font-size: 18px;\">, their share of foreign patent filings compared to domestic filings were trailing above 90%. This is in line with the observation that most of the patent applicants of Brazil came from foreign origins (almost 90% of the top 1000 applicants) and had opted for the largest firms to represent them locally. Some of the largest international applicants include American <\/span><a href=\"https:\/\/app.ip-pilot.com\/applicants\/qualcomm-inc-us\/overview?date_from=1980&amp;date_to=2023&amp;date_type=M&amp;family_type=T%2CP&amp;locale=en-US\" data-fusion-font=\"true\" style=\"font-size: 18px;\">QUALCOMM<\/a><span data-fusion-font=\"true\" style=\"font-size: 18px;\"> and <\/span><a href=\"https:\/\/app.ip-pilot.com\/applicants\/dow-global-technologies-llc-us\/\" data-fusion-font=\"true\" style=\"font-size: 18px;\">DOW GLOBAL TECHNOLOGIES LLC<\/a><span data-fusion-font=\"true\" style=\"font-size: 18px;\">, Chinese <\/span><a href=\"https:\/\/app.ip-pilot.com\/applicants\/huawei-tech-co-ltd-cn\/\" data-fusion-font=\"true\" style=\"font-size: 18px;\">HUAWEI TECH CO LTD<\/a><span data-fusion-font=\"true\" style=\"font-size: 18px;\">, and German <\/span><a href=\"https:\/\/app.ip-pilot.com\/applicants\/basf-se-de\/\" data-fusion-font=\"true\" style=\"font-size: 18px;\">BASF<\/a><span data-fusion-font=\"true\" style=\"font-size: 18px;\">. There was also a preference by the underlying applicants to file the Brazilian patents via PCTs rather than directly into the country (86% compared to 14%).<\/span><\/p>\n<\/div><div class=\"fusion-menu-anchor\" id=\"BR-trademarks\"><\/div><div class=\"fusion-text fusion-text-7\"><p data-fusion-font=\"true\" style=\"font-size: 18px;\">Looking at the international exchange of cases, the American, German, and Japanese law firms were among Brazil&#8217;s top partners. The US alone sent 40% of almost 42,000 cases and was also the top country to receive back prosecution work from Brazilian inventors (30% of 3,343 cases).<\/p>\n<\/div><div class=\"fusion-text fusion-text-8\"><h3 class=\"fusion-responsive-typography-calculated\" data-fontsize=\"32\" data-lineheight=\"37.12px\" style=\"--fontSize: 32; line-height: 1.16;\">Trademark Prosecution<\/h3>\n<p><span data-fusion-font=\"true\" style=\"font-size: 18px;\">Meanwhile, more than half a million (573,257) trademark filings were executed by 673 representatives between 2018 and 2022. Similar to the patents world, the largest firms remained attractive to international applicants with foreign trademark filings occupying 72% of the total trademark filings for the 20 largest trademark prosecution firms.<\/p>\n<p><span data-fusion-font=\"true\" style=\"font-size: 18px;\">There were, however, two significant differences between trademark and patent prosecution trends in Brazil. Firstly, it was the locals which filed the most number of trademark applications &#8211; 63% to be exact &#8211; in Brazil over the last five years. The largest filers are Brazil&#8217;s <\/span><a href=\"https:\/\/app.ip-pilot.com\/applicants\/globo-comunicacao-e-participacoes-s-a-br\/\" data-fusion-font=\"true\" style=\"font-size: 18px;\">GLOBO COMUNICACAO E PARTICIPACOES S A<\/a><span data-fusion-font=\"true\" style=\"font-size: 18px;\"> and <\/span><a href=\"https:\/\/app.ip-pilot.com\/applicants\/hypera-s-a-br\/\" data-fusion-font=\"true\" style=\"font-size: 18px;\">HYPERA S A<\/a><span data-fusion-font=\"true\" style=\"font-size: 18px;\">, American <\/span><a href=\"https:\/\/app.ip-pilot.com\/applicants\/amazon-tech-inc-us\/\" data-fusion-font=\"true\" style=\"font-size: 18px;\">AMAZON TECH INC<\/a><span data-fusion-font=\"true\" style=\"font-size: 18px;\">, <\/span><a href=\"https:\/\/app.ip-pilot.com\/applicants\/target-brands-inc-us\/\" data-fusion-font=\"true\" style=\"font-size: 18px;\">TARGET BRANDS INC<\/a><span data-fusion-font=\"true\" style=\"font-size: 18px;\"> and <\/span><a href=\"https:\/\/app.ip-pilot.com\/applicants\/johnson-johnson-us\/\" data-fusion-font=\"true\" style=\"font-size: 18px;\">JOHNSON &amp; JOHNSON<\/a><span data-fusion-font=\"true\" style=\"font-size: 18px;\">. Secondly, 91% of the total trademark filings executed by Brazilian firms were done directly rather than with a Madrid Protocol association.<\/span><\/p>\n<h3 class=\"fusion-responsive-typography-calculated\" data-fontsize=\"32\" data-lineheight=\"37.12px\" style=\"--fontSize: 32; line-height: 1.16;\">Final Remarks<\/h3>\n<p data-fusion-font=\"true\" style=\"font-size: 18px;\">In summary, we observe that patent filing representations are more concentrated and mostly helmed by the 20 largest patent prosecution firms whereas trademark filing representations are more dispersed. This could largely be attributed to the profiles of the underlying applicants behind these filings, primarily their origins.<\/p>\n<p><span data-fusion-font=\"true\" style=\"font-size: 18px;\">We also don&#8217;t see much overlap amongst the 5 largest patent firms and 5 largest trademarks prosecution firms, with the exception of <\/span><a href=\"https:\/\/app.ip-pilot.com\/law-firms\/dannemann-siemsen-bigler-ipanema-moreira-br\/\" data-fusion-font=\"true\" style=\"font-size: 18px;\">DANNEMANN, SIEMSEN, BIGLER &amp; IPANEMA MOREIRA<\/a><span data-fusion-font=\"true\" style=\"font-size: 18px;\"> which has, in fact, quite a balanced IP (6:4 ratio) portfolio.
